Section 12.04.350 Widths of sidewalks.
A. All sidewalks hereafter constructed in the city shall
be of the following widths and shall be
the responsibility of the owner of the premises:
1. Walks on Main Street between 1st Street and 4th Street,
including a six-inch curb, shall be
twelve (12) feet in width.
2. Walks on Main Street between 4th Street and 5th Street,
including a six-inch curb, shall be
eight feet in width.
3. Walks on 1st Street between Bedford Street and Cherry
Street, including a six-inch curb,
shall be ten feet in width.
4. Walks on 2nd Street between Bedford Street and Cherry
Street, including a six-inch curb,
shall be ten feet in width.
5. Walks on 3rd Street between State Street and Pinckney
Street, including a six- inch curb,
shall be ten feet in width.
6. Walks in Midway Addition and that portion of Edgemont
Addition lying within the city
limits, including a six-inch curb, shall be five feet in width.
7. All other sidewalks within the corporation limits
of the city shall be as follows:
a. Upon and along all streets and avenues, upon which
or along which no sidewalk whatever
has heretofore been constructed, shall be five feet in width, and the city council shall determine if
such sidewalks shall be combined sidewalks and curbs or shall be separate sidewalk from curb.
b. Upon and along all streets and avenues, upon or along
which sidewalks have heretofore
been constructed, all new sidewalks or reconstructed sidewalks shall be in conformity with the
previously constructed sidewalks.
B. Permit Required and Fee. Each and every application
for a permit to construct any sidewalk
and/or curb within the city shall be accompanied by, attached to and become a part of such
application, an approved surveyor's certificate showing that the lines for such sidewalks and/or curb
have been properly laid out, the expenses for which shall be borne by the property owner.
C. A charge often dollars ($10.00) shall be collected
for the issuance of each and every such
permit for the construction of sidewalks and/or curbs by the director of public works or other
authorized person, the charges for which shall be the responsibility of the property owner. (Ord. 165
