Section 12.16.080 Responsibility for trees and vegetation.

    The abutting property owner shall be responsible for the regular watering, care and maintenance of trees and vegetation growing in the adjacent public right-of-way and shall comply with all city rules and regulations. The council and/or director may require any property owner to treat or remove any tree or vegetation in the boulevard, right-of-way, alleys or parking strip abutting upon the owner’ s property.
    A.    The city parks and recreation department may take action to remove or order removal or have tested or treated any tree or vegetation in public or private area if:
    1.    It is diagnosed to have an epidemic insect infestation or disease that would prove to be detrimental to other trees or vegetation;
    2.    It creates a hazard or an immediate threat to public safety; or
    3.    It is identified as a tree or vegetation that would be either an obstruction or would not live after a street, sidewalk, curb and gutter, alley or public utility construction or maintenance project is implemented.
    B.    The cost to the city of any of the above actions may be assessed against the abutting property owner. Normal removal time will be within thirty (30) days of notification. The director or his/her designee will determine emergency removal time. (Ord. 195 (part), 2002)
