Section 13.08.060 Termination of service.

A.    Any time fraudulent use of water is detected or the department’ s regulating or measuring equipment has been tampered with, or an emergency situation is found to exist on the user’ s premises, the director of public works may direct the water be shut off immediately without notice.
B.    In all other circumstances; the director of public works may not discontinue service on Friday, Saturday, Sunday, a legal holiday or a day prior to a legal holiday. All disconnections shall be performed between the hours of eight a.m. and four p.m.
C.    If water is turned off for any violation of this chapter, a thirty-five dollar ($35.00) reconnect fee shall be paid before water service is restored, as provided in Section 13.04.110(B) temporary discontinuance.
D.    The reconnect fee shall be applied at the time the department arrives at the address to be turned off. The reconnect fee shall be assessed if the water cannot be turned off due to a faulty non-working curb stop valve or if the curb stop valve is found inaccessible.
E.    Before water service is restored, the reconnect fee and all water bills, delinquent and current, shall be paid. At the discretion of the director of public works a written payment arrangement may be entered into. For each month the account is past due, the lawful rate of interest, currently ten percent (10%) per annum, shall be charged.
F.    An account is past due if it has not been paid in full within thirty (30) days of the date it was billed. If the payment agreement is violated, the total amount becomes due immediately. If this amount is not paid, the water supply shall again be terminated. (Ord. 215 (part), 2003: Ord. 124 (part), 1997: Ord. 111 (part), 1996: prior code § 4.02.045)
