Section 16.16.060 Final plat approval.

    A.    The city shall approve or disapprove the final plat within forty-five (45) days of its presentation to the director of community development. The director of community development shall examine the final subdivision plat and shall recommend approval only when it conforms to the conditions of approval set forth on the preliminary plat and to the terms of the Montana Subdivision and Platting Act and these regulations.
    B.    The city shall examine every final subdivision plat and shall approve it when and only when it conforms to the conditions of approval set forth for the preliminary plat and to the terms of the Montana Subdivision and Platting Act and these regulations.
    C.    If the final plat is disapproved, the reasons for disapproval shall be stated in the records of the city council and a copy forwarded to the applicant. The city shall return the final plat to the subdivider within ten days of the action. The applicant may then make the necessary corrections and resubmit the final plat for approval. Approval shall be certified by the city on the face of the final plat, and the county treasurer shall certify that all taxes have been paid on the land proposed for subdivision. The acceptance of land dedications shall be made by specific resolution of the city council and noted on the final plat.
    D.    The city may withdraw approval of a plat if it determines that such information provided by the subdivider, and upon which such decision was made, is inaccurate. (Ord. 131 (part), 1998: prior code § 16.01.020C-6)
