Section 16.24.050 City council recommendation.

    The city council shall:
    A.    Consider the following:
    1.    Relevant evidence relating to the public health, safety, and welfare;
    2.    Any officially adopted comprehensive plan for the area involved;
    3.    Review criteria specified (see Section 16.24.060); and
    4.    Whether the preliminary plat conforms to the provisions of:
    a.    The Montana Subdivision and Platting Act;
    b.    These regulations;
    c.    Applicable zoning regulations;
    d.    Any officially adopted comprehensive plan for the area involved; and
    e.    Other regulations in effect in the area of the proposed subdivision.
    B.    Within thirty-five (35) days of determination of completeness, submit in writing the following:
    1.    Its findings regarding the items under subsection A of this section;
    2.    Recommended findings of fact that weigh the review criteria pursuant to Section 76-3-608 MCA; and
    3.    A recommendation for approval, conditional approval, or disapproval of the plat. (Ord. 131 (part), 1998: prior code § 16.01.030B-5)
