Section 17.104.155 Maintenance and removal of signs.

    A.    Maintenance.
    1.    All signs shall be maintained in a safe and presentable condition.
    B.    Unlawful signs include but are not limited to:
    1.    Prohibited signs;
    2.    Signs described in subsection 17.104.040(3);
    3.    Signs installed without a permit;
    4.    Unlawful signs shall be removed or brought into compliance within sixty (60) calendar days of notice from the city. Removal of unlawful signs shall be the responsibility of the owner of the sign and/or the owner of the premises.
    C.    Abandoned Signs.
    1.    Permanent signs and signs applicable to a business temporarily suspended because of a change of ownership or management shall be deemed abandoned if the property remains vacant for one hundred eighty (180) calendar days.
    2.    An abandoned sign is prohibited and shall be removed by the owner of the sign and/or the owner of the premises.
    3.    Sign cans and signs not is use by the occupant of the property where the same is located shall be considered an abandoned sign.
    D.    Ordinary maintenance such as re-painting, changing copy (excluding name change), repairing or replacing parts shall neither require a new permit, nor cause a legal nonconforming sign to become unlawful if it does not increase the noncompliance of the sign. (Ord. 225 (part), 2003)
