Section 2.04.090 Vacancies and oath of office.
Each officer of the city must take the oath of office, and
file the same, duly approved, within
ten days after receiving notice of his or her election or appointment; or, if no notice be received,
then on or before the date fixed for the same assumption by him or her of the duties of the office
to which he or she may have been elected or appointed, but if any one, either elected or
appointed to office, fails for ten days to qualify as required by law, or enter upon his or her duties
at the time fixed by law, then such office becomes vacant; or if any officer or council absents
himself or herself from the city continuously for ten days without the consent of the council, or
openly neglects or refuses to discharge his or her duties, such office may by the council be
declared vacant; or if any officer removes from the city, or any councilmember from his or her
ward, such office must be by the council declared vacant. (Ord. 131 (part), 1998: prior code §
