Section 2.36.050 Qualifications of city judge.
A. Any person shall be eligible to
hold the office of city judge who is a citizen of the United
States and who has been a resident of Ravalli County for at least one year prior to election or
appointment to this office.
B. The salary and compensation of
the city judge shall be fixed annually by resolution of
the city council. The office hours for the city judge shall be eight a.m. to five p.m. daily except
on legal holidays and nonjudicial days.
C. Each person elected or appointed
to serve as the city judge shall obtain a certificate of
completion of a course of education and training prescribed by the Montana Supreme Court
Commission on Courts of Limited Jurisdiction before assuming the function of his or her office
unless the judge obtains a temporary certificate as prescribed by Section 3-1-1503 MCA. The
city judge shall abide by and follow all ethical and judicial standards applicable to judges.
D. Before entering upon the duties
of his/her office, the city judge shall take the
constitutional oath of office which shall be filed with the city clerk. Before taking the oath, the
elected or appointed judge shall satisfy the clerk that the judge is certified as stated above.
E. The city judge shall collect and
receive all monies legally payable on any citation,
complaint, process or order issued to any person from the city court, and the city court must
collect and pay the same over to the parties entitled or authorized to receive them without the
delay and account for the same on a monthly basis to the city. (Ord. 102 (part), 1996: prior code
