Section 8.04.030 Duties.
A. The health officer shall have and
exercise a general supervision over the sanitary
conditions of the city; and all orders and directions emanating from the health department shall
be issued in the name of the health officer.
B. The health officer shall make sanitary
inspections whenever and wherever the health
officer has reason to suspect anything exists which may be detrimental to the public health.
C. It shall be the duty of the health
officer to enforce all laws of the state and city, and all
rules and regulations of the board of health in relation to the sanitary condition of the city; to
cause all nuisances to be abated with reasonable promptness.
D. The health officer shall, as secretary
of the board of health of the city, by a written
instrument under his/her hand, order the destruction, prevention or removal, within a specified
time, of all nuisances, sources of filth or causes of sickness, as directed by the board of health.
E. The health officer shall, whenever
in his or her judgment and upon approval in writing
by the Secretary of the State Board of Health of the state of Montana, order all buildings, such as
schoolhouses, churches, theatres, or other places where people congregate in considerable
numbers, to be closed in time of epidemic or in the face of serious or unusual sickness whenever
safety may require the same, and may forbid and prevent the assembling of the people in any
place when the public health and safety demand the same.
F. The health officer shall visit
and examine or cause to be visited and examined, all sick
persons reported to him as sick, or supposed to be sick with smallpox, cholera or any contagious,
infectious or epidemic disease, and cause such persons, if necessary, to be removed to the
hospital or place provided for persons sick with a contagious disease, and when so removed to
cause them to be provided with suitable nurses, medical attendance and medicine. If the person
so removed is unable to pay the expense thereof, it shall be paid for in the manner provided by
law.
G. In the case of pestilence or epidemic
disease or danger therefrom, it shall be the duty of
the health officer to adopt all such precautions as in the health officer's judgment may be
required to prevent the entrance or spread of any contagious diseases. Any emergency rules the
health officer shall believe the public health and safety demand, shall be reported to the council
for approval as soon after promulgation as possible.
H. The health officer shall impose
such restrictions upon and exercise such supervision over
all persons afflicted with contagious or epidemic disease as shall be necessary to protect from
such disease all persons not of necessity connected with any person so afflicted or sick.
I. The health officer shall attend
any sick or injured prisoner in the city jail, examine all
police officers and firefighters who may apply for sick leave permits, and purchase at the city's
expense such medical and surgical supplies as may be required for prisoners.
J. The health officer shall advise
the board of health upon all matters relating to the public
health and the necessary steps to be taken for the prevention or eradication of disease and
perform such other duties as may be necessary for the protection of the public health as shall be
required of the health officer by the board of health.
K. The health officer shall once each
month submit to the council a report of such matters
connected with the health department, as the health officer may deem necessary.
L. On or before May 1st, of each year,
the health officer shall file with the clerk a statement
of the work of the health department during the preceding year, together with such information
and suggestions as the health officer shall deem proper.
M. The health officer shall also prepare
and submit to the council, not later than March 1st
of each year, a detailed estimate of the whole cost and expense of providing for and maintaining
the health department during the current fiscal year.
N. The health officer, when directed
by the mayor or city attorney, shall visit, investigate
and examine all cases of physical injury or illness claimed or alleged to result from defective
streets, alleys, sidewalks and bridges, or from any cause which might render the city liable for
damage, and shall report the result of said visit, investigation and examination to the mayor or
