Section 8.12.010 Definitions.

    For the purposes of this chapter, the following definitions shall apply:
    "Business district" means all business located within the C-1 Local Business District; C-2 Highway Related Business District; CDBC Downtown Business Commercial District; and PI Public and Institutional District.
    "Fire extinguisher" means a portable device containing an extinguishing agent that can be expelled under pressure for the purpose of suppressing or extinguishing a fire. A minimum rating of Type 2A is required (see Section 8.12.030).
    "Fireworks" means any combustible or explosive composition or any substance, combination of substances, or article prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration, or detonation and includes sky rockets, roman candles, bottle rockets, dayglo bombs, blank cartridges, toy cannons, toy canes or toy guns in which explosives other than toy paper caps are used, the type of balloons which require fire underneath to propel them, firecrackers, torpedoes, sparklers or other fireworks of like construction, any fireworks containing any explosive or flammable compound, or any tablets or other device containing any explosive substance.
    "Fireworks stand" means a small, temporary, often open-air structure, booth, or other portable stand-alone structure designed and constructed of wood or metal, utilized for the express purpose of display and sale of fireworks at retail.
    "License" means the document issued by the city of Hamilton.
    "Permissible fireworks" are set forth in the Hazardous Material Regulations (HMR; 49 CFR parts 171-180) specifically regulations applicable to fireworks in Section 173.56(j) and the hazardous material table Section 172.101). MCA 50.37 specifically prohibits skyrockets, roman candles and bottle rockets.
    "Prohibited fireworks" are skyrockets, roman candles and bottle rockets. Illegal explosives are usually unlabelled and these devices exceed the federal maximum explosive charge allowed. Some examples are M-80’ s, M-100’ s and silver salutes.
    "Retail fireworks vendor" refers to any person, persons, firm, organization, partnership, limited liability company, or corporation which sells, gives away, or otherwise disposes of permissible fireworks or attempts to sell, give away, or otherwise dispose of permissible fireworks within the municipal limits of the city of Hamilton.
    "1.3G explosives" formerly known as Class B special fireworks. Items classified as 1.3G explosives are display fireworks.
    "1.4G explosives" formerly known as Class C common fireworks. Items classified as 1.4G explosives are consumer fireworks intended for use by the general public. (Ord. 223 (part), 2003)
